Common European Sales Law and EU-Competence: A Never Ending Game?

What is the legal basis for the proposed Common European Sales Law: art. 114 TFEU or art. 352 TFEU? The European Commission must clarify this issue before engaging the analysis of the concrete provisions of the CESL.
